Verdict Ferguson vs. Marten Transport

STATE COURT OF DEKALB COUNTY STATE OF GEORGIA, DAVID T. FERGUSON v. WILLIE LOVE AND MARTEN TRANSPORT, LTD

At the time of the accident, Mr. Ferguson was stopped at a red light facing west on Camp Creek Parkway at its intersection with Welcome All Road in Fulton County, Georgia. Mr. Love, who was driving an 18 wheel truck owned by Marten Transport, was traveling west on Camp Creek Parkway toward its intersection with Welcome All Road.

Mr. Love failed to stop his tractor trailer truck as he approached the red light and struck Mr. Ferguson’s vehicle from behind. This was a low speed impact resulting in very little damage to Mr. Ferguson’s car. Fulton County police responded to the scene, and Mr. Love was issued a citation for following to closely.

As a result of the collision, Plaintiff experienced pain in his right arm, shoulder, neck chest, back, knee and hip, and in his left shoulder and chest. Mr. Ferguson had a bulging disc at L3-4 and L5-S1. Mr. Ferguson required surgery to repair bone-on-bone medical changes in his right knee due to the impact of the accident. Mr. Ferguson has a history of two prior surgeries on his right knee which the Defendants used to dispute claims that his current knee surgery was caused by the wreck.

The case settled before trial after mediation in the amount of two hundred twenty five thousand dollars ($225,000.00).
